The government has recently announced that they will change the law to allow taxi licensing authorities to apply for Enhanced CRB Checks for all taxi licensing applications. When this change comes into effect, licensing authorities will be able to check whether the person applying for a taxi licence is also barred from working with children or vulnerable adults as part of the Enhanced Check.
The current position is that licensing authorities can only apply for an Enhanced Check on drivers who regularly pick up children or vulnerable adults. It has however become commonplace for many licensing authorities to apply for Enhanced Checks for all taxi and private hire licences.
This change requires secondary legislation and at the moment there is no date set for its introduction.
